The court ruled 7-2, with Justice Stephen Breyer writing for the majority, striking down a lower court ruling, saying the plaintiffs — Texas and 17 other GOP-led states — did not have the standing to sue. “We conclude that the plaintiffs in this suit failed to show a concrete, particularized injury fairly traceable to the defendants’ conduct in enforcing the specific statutory provision they attack as unconstitutional,” Justice Stephen Breyer wrote.
It is not likely that the latest challenge to the Affordable Care Act (ACA), also known as Obamacare, will be successful. It occurred Nov. 10, when the U.S. Supreme Court heard arguments against the national health care law passed under the Obama administration in the case California v. Texas, No. 19-840.
“Right now, under the Affordable Care Act, it is your right to have access to lactation support and counseling without cost-sharing for as long as you are breastfeeding. If the ACA gets struck down, then insurers will not be required to cover it, which could have devastating impacts on new parents,” noted Andrea Ippolito, a health tech expert and founder of SimpliFed, a company that assists mothers who breastfeed.

According to results of a recent survey, 56 percent of uninsured Californians are unaware of the new mandate. The study, conducted by Covered California – the state’s independent government insurance exchange – also “found that avoiding the penalty motivates those with health insurance to keep their coverage and encourages the uninsured to sign up.”
“I am deeply disappointed by the decision of the U.S. Court of Appeals for the 5th Circuit to support the Republicans in their relentless campaign to repeal Obamacare and strip away its protections for people with pre-existing conditions. This case is further evidence that Republicans will stop at nothing to strike down Obamacare and take away health coverage from millions of Americans.
