LAUSD Will Seek Temporary Restraining Order to Stop May 15 Teacher Strike

Lawyers for the Los Angeles Unified School District (LAUSD) will go to Superior Court at 8:30 a.m. on Tuesday, May 12, seeking a Temporary Restraining Order to stop United Teachers Los Angeles (UTLA), the teachers’ union, from proceeding with a one-day teachers’ strike. The strike is scheduled for the entire school day on Friday, May 15.

“Time is of the essence,” said Roberta Fesler, General Counsel for LAUSD.

This is not the first step in the District’s efforts to stop the walkout, which is scheduled on a school day during the time that students are scheduled to take state standardized tests and Advanced Placement examinations.

The LAUSD Office of General Counsel filed an Unfair Practice Charge and a Petition for Injunctive Relief with the California Public Employment Relations Board (PERB) on Wednesday, May 6.  In response, PERB issued a complaint today alleging that UTLA has engaged in an unfair labor practice by calling for the strike. However, issuance of the PERB complaint would not stop the May 15 strike.

“PERB has scheduled an informal settlement conference between the District and UTLA on this matter for Wednesday,” Fesler said. “The PERB Board may not act on our request for injunctive relief until then. If so, there wouldn’t be time to go before the Superior Court before the start of school on Friday when teachers plan to abandon their classrooms. For that reason, we have to act now.”
